Terms & Conditions

By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Site.

Your continued use of the Site following the posting of any changes to these Terms constitutes acceptance of those changes. We will notify registered users of material changes via email or a prominent notice on the Site.

• “Content” means all text, images, data, listings, routes, reviews, comments, feedback, suggestions, and other materials displayed on, uploaded to, or transmitted through the Site.
• “User Content” means any Content that users submit, post, or transmit to the Site, including but not limited to crawl routes, bookmarks, check-ins, reviews, photos, and profile information.
• “Store Listing” means a directory entry for a thrift store, consignment shop, vintage store, or similar retail establishment displayed on the Site.
• “Crawl” or “Crawl Route” means a curated itinerary of two or more Store Listings created by a user for the purpose of planning a shopping trip.
• “Services” means all features, tools, and functionality available through the Site, including store search, geolocation, route planning, mapping, bookmarking, check-ins, badges, events, and membership features.
• “Personal Data” has the meaning given under applicable data protection laws, including the GDPR, UK GDPR, CCPA/CPRA, PIPEDA, LGPD (Brazil), POPIA (South Africa), and the Australian Privacy Act 1988.

You must be at least 16 years old to create an account or use our Services. By using the Site, you represent and warrant that you meet this age requirement.

If you are between the ages of 16 and 18 (or the age of majority in your jurisdiction), you may only use the Site under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

If you are accessing the Site from the European Economic Area (EEA) or the United Kingdom, you must be at least 16 years old to create an account, in accordance with the General Data Protection Regulation (GDPR). If you are accessing the Site from the United States, you must be at least 13 years old in accordance with the Children’s Online Privacy Protection Act (COPPA).

Certain features of the Site require you to create an account. When you register, you agree to:

1. Provide accurate, current, and complete information during registration;
2. Maintain and promptly update your account information to keep it accurate and complete;
3. Maintain the security and confidentiality of your login credentials;
4. Accept responsibility for all activities that occur under your account;
5. Notify us immediately of any unauthorized use of your account or any other breach of security.

You may not use another person’s account without their express permission. We reserve the right to suspend or terminate accounts that we reasonably believe have been created fraudulently, contain inaccurate information, or violate these Terms.

You may delete your account at any time from your account settings page. Account deletion is self-service and takes effect immediately. Upon deletion, all personal data — including your profile, crawl routes, bookmarks, check-ins, photos, event history, and membership records — will be automatically and permanently removed from our systems in accordance with our Privacy Policy and applicable data retention laws.

5.1 License Grant

By submitting User Content to the Site, you grant UrbanThrifter a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content in connection with operating and providing the Services.

This license continues even if you stop using the Services, but only to the extent necessary for the continued operation of the Site (e.g., crawl routes that have been shared publicly or embedded in other users’ itineraries).

5.2 Your Responsibilities

You are solely responsible for your User Content. You represent and warrant that:

1. You own or have the necessary rights and permissions to submit the User Content;
2. Your User Content does not infringe upon the intellectual property rights, privacy rights, or any other rights of any third party;
3. Your User Content does not contain any material that is defamatory, obscene, threatening, or otherwise unlawful;
4. Your User Content is accurate to the best of your knowledge.

5.3 Content Moderation

We reserve the right, but are not obligated, to monitor, review, edit, or remove any User Content at our sole discretion, for any reason, including but not limited to Content that we believe violates these Terms, is objectionable, or could harm the reputation of UrbanThrifter or its users.

5.4 No Endorsement

User Content does not reflect the views or opinions of UrbanThrifter. We do not endorse any User Content or any opinion, recommendation, or advice expressed therein.

The Site allows users to create, save, share, and discover Crawl Routes — curated itineraries of thrift stores. When you create a Crawl Route:

1. Public Crawls are visible to all visitors and may be featured, indexed, or shared by UrbanThrifter;
2. Private Crawls are visible only to you unless you share them via a direct link;
3. Driving directions, estimated travel times, and distances are provided by third-party mapping services (Google Maps) and are estimates only — actual conditions may vary;
4. You are responsible for your own safety when following any Crawl Route. UrbanThrifter is not responsible for road conditions, traffic, closures, or any incidents that occur during your trip;
5. UrbanThrifter is not responsible for stores being closed, relocated, or out of business when you visit them as part of a Crawl Route.

7.1 No Guarantee of Accuracy

Store Listings on the Site are compiled from a variety of sources, including publicly available data, third-party data providers, user submissions, and store owner claims. While we strive to maintain accurate and up-to-date information, we do not warrant or guarantee the accuracy, completeness, reliability, or timeliness of any Store Listing information, including but not limited to:

• Store names, addresses, and contact information;
• Business hours and holiday schedules;
• Product availability, pricing, or inventory;
• Store status (open, closed, temporarily closed, or permanently closed);
• Photos, descriptions, or other descriptive content;
• Geographic coordinates and map pin placement.

7.2 Store Owner Claims

Store owners may claim and manage their listing on the Site. Claimed listings may contain information provided directly by the store owner. UrbanThrifter does not verify all claims and is not responsible for the accuracy of information provided by store owners.

7.3 Your Due Diligence

You should independently verify store information (especially hours and location) before visiting. UrbanThrifter is not liable for any losses, costs, or inconvenience resulting from inaccurate or outdated listing information.

Certain features of the Site use geolocation technology to provide location-based services, including “Near Me” search, distance-sorted results, and Crawl Route planning.

8.1 Consent

We will request your permission before accessing your device’s location data through your browser’s geolocation API. You may deny or revoke this permission at any time through your browser or device settings.

8.2 Data Handling

When you grant geolocation permission, your approximate coordinates may be:

• Stored locally on your device (in browser storage) to improve your experience across pages and sessions — this requires your consent where required by applicable law;
• Transmitted to our servers to calculate distances and sort search results — coordinates are used for the request only and are not permanently stored on our servers;
• Sent to third-party mapping services (Google Maps) to render maps and calculate driving directions.

8.3 Accuracy

Geolocation accuracy varies by device, network conditions, and environmental factors. Distance calculations are approximate and should not be relied upon for navigation. Always use a dedicated navigation application for driving directions.

UrbanThrifter offers a gamification system that awards badges, tiers, and achievements to stores and users based on activity such as crawl participation and check-ins.

1. Badges and achievements are for entertainment and community engagement purposes only and have no monetary value;
2. We reserve the right to modify, recalculate, or remove badges and achievement tiers at any time without notice;
3. Badge criteria (e.g., check-in thresholds, crawl appearance counts) may change as we refine the system;
4. Fraudulent check-ins or attempts to manipulate the badge system may result in account suspension or termination.

10.1 Earning Points

UrbanThrifter offers a loyalty program called “Thrift Cred” that awards points to users for platform activities such as store check-ins, ratings, crawl completion, event attendance, haul creation, and other engagement. Point values for each activity are determined by UrbanThrifter and may be modified at any time without notice.

10.2 Points Multipliers

Paid membership tiers and custom plans may include a points multiplier that increases the rate at which Thrift Cred is earned. Multiplier rates are determined by your membership level and may change if you upgrade, downgrade, or modify your plan.

10.3 No Monetary Value

Thrift Cred points have no cash value and cannot be exchanged for currency, transferred to other users, or redeemed outside the UrbanThrifter platform. Points are not property and do not constitute a stored-value account, gift card, or financial instrument under any applicable law.

10.4 Redemption

Points may be redeemed for rewards available in the UrbanThrifter Rewards Store, including branded merchandise and other items as offered from time to time. Reward availability, point costs, and redemption terms are subject to change. When redeeming points for physical merchandise:

1. You are responsible for providing accurate shipping information;
2. Merchandise is fulfilled by third-party partners (including Printify) and is subject to their production and shipping timelines;
3. Points are deducted at the time of redemption and are non-refundable once an order has been submitted for fulfillment;
4. Defective or damaged items should be reported to support@urbanthrifter.com within 14 days of receipt.

10.5 Levels & Leaderboards

Users may progress through achievement levels (e.g., Novice, Scout, Adventurer, Expert, Master) based on accumulated Thrift Cred. Leaderboard rankings display usernames publicly. Level thresholds and tier names may be adjusted at any time.

10.6 Anti-Gaming & Adjustments

To maintain fairness, UrbanThrifter enforces daily point caps, cooldown periods between identical actions, and GPS validation for check-in points. We reserve the right to:

1. Recalculate, adjust, or reset point balances if we detect abuse, fraud, or system errors;
2. Modify earning rates, redemption values, or level thresholds;
3. Suspend or terminate points accounts for users who violate these Terms;
4. Discontinue the Thrift Cred program with reasonable notice to active users.

In the event of program discontinuation, we will provide at least 60 days’ notice for users to redeem outstanding points, after which unredeemed points will expire.

11.1 Dashboard Tools

UrbanThrifter provides optional selling and business management tools for resellers, including inventory management, sales tracking, sales analytics, tax estimation tools, consignment management, and a financial ledger. These tools are available to paid members based on their membership tier or custom plan selections.

11.2 Not Professional Advice

The selling tools, tax center, tax export features, and analytics provided by UrbanThrifter are informational tools only and do not constitute professional financial, tax, legal, or accounting advice. You should consult qualified professionals for tax filing, financial decisions, and regulatory compliance. UrbanThrifter is not responsible for errors in tax calculations, sales reports, or financial summaries generated by the platform.

11.3 Data Accuracy

You are solely responsible for the accuracy of data you enter into the selling tools, including inventory items, purchase prices, sale amounts, expenses, and consignment terms. UrbanThrifter does not verify or audit user-entered financial data.

11.4 Platform Integrations

The selling tools integrate with third-party selling platforms through authorized APIs and data imports:

1. eBay: As an authorized eBay partner, UrbanThrifter syncs your active listings, completed sales, and seller fees via eBay’s OAuth API. By connecting your eBay account, you authorize UrbanThrifter to access and store this data on your behalf. Your use of eBay is subject to eBay’s User Agreement;
2. Etsy: UrbanThrifter syncs your Etsy shop listings and receipts via Etsy’s OAuth API. By connecting your Etsy account, you authorize UrbanThrifter to access and store this data. Your use of Etsy is subject to Etsy’s Terms of Use;
3. CSV Imports: You may import listing and sales data from Poshmark, Mercari, Depop, Whatnot, and other platforms via CSV file upload. You are responsible for ensuring you have the right to export and use this data;
4. Auto-Delist: When enabled, UrbanThrifter may automatically delist or deactivate items on connected platforms when they are marked as sold. This action is irreversible — UrbanThrifter is not liable for listings that are deactivated in error.

11.5 Consignment

The consignment management feature allows you to track items received from third-party consigners, calculate commission splits, and record payouts. UrbanThrifter is not a party to any consignment agreement between you and your consigners. You are solely responsible for fulfilling your consignment obligations.

11.6 Data Retention

Selling tool data (inventory, sales, expenses, consignment records) is retained for as long as your account is active. Upon account deletion, this data is permanently removed in accordance with our Privacy Policy. We recommend exporting your data before deleting your account.

12.1 Hauls

Users may create “haul” posts to share photos and reviews of their thrift finds. Haul content is User Content subject to the license and responsibilities described in Section 5. By posting a haul, you confirm that:

1. You own the photos and content you upload;
2. Your haul does not contain misleading product claims or counterfeit goods;
3. You consent to other users viewing and engaging with your haul content.

12.2 Store Perks & Promotions

Store owners who have claimed their listing may create perks, promotions, and discount offers for visitors. Regarding store perks:

1. Perks are created and managed solely by the store owner — UrbanThrifter does not verify, guarantee, or endorse any perk offer;
2. UrbanThrifter is not responsible for the fulfillment, honoring, or value of any perk or promotion offered by a store;
3. Store owners are responsible for ensuring their perks comply with applicable consumer protection and advertising laws;
4. Users should verify perk validity directly with the store before relying on any offer.

12.3 AI-Generated Content

UrbanThrifter offers an AI-powered description writer for store owners to generate store listing descriptions. AI-generated content:

1. Is produced using third-party AI services (OpenAI) and may contain inaccuracies;
2. Should be reviewed and edited by the store owner before publishing;
3. UrbanThrifter does not claim ownership of AI-generated descriptions — the store owner who requests generation is responsible for the published content;
4. User input data (store name, category, location) is transmitted to OpenAI for processing. See our Privacy Policy for details on third-party data processing.

13.1 Free & Paid Services

The Site offers both free and paid membership tiers. Certain features may be restricted to paid members. We reserve the right to change which features are available in each tier.

13.2 Payment Terms

If you purchase a paid membership or any other paid service:

1. You agree to pay all applicable fees as described at the time of purchase;
2. Payments are processed through third-party payment processors. We do not directly store your payment card information;
3. Subscription memberships automatically renew at the end of each billing period unless you cancel before the renewal date;
4. All fees are stated in U.S. Dollars (USD) unless otherwise specified.

13.3 Refunds

Refund requests are handled on a case-by-case basis. To request a refund, contact us at support@urbanthrifter.com within 14 days of purchase. For users in the European Union or United Kingdom, you have a statutory right to a 14-day cooling-off period for online purchases, during which you may cancel for a full refund.

13.4 Price Changes

We reserve the right to change our pricing at any time. For existing subscribers, price changes will take effect at the next renewal period. We will provide at least 30 days’ notice of any price increases.

13.5 Custom Plans (“Build Your Plan”)

In addition to fixed membership tiers, UrbanThrifter offers a custom plan builder that allows users to select individual premium features at individual monthly prices. Regarding custom plans:

1. Price Lock Guarantee: Custom plan prices are locked for a period specified at the time of subscription (currently 3 years). During the lock period, if UrbanThrifter raises feature prices, your plan price remains unchanged. If UrbanThrifter lowers feature prices, your plan price automatically decreases to reflect the lower rates;
2. Feature Changes: You may add or remove features from your custom plan at any time. Changes take effect at the start of your next billing cycle — you retain access to removed features until the end of the current cycle, and newly added features become available at the start of the next cycle;
3. No Mid-Cycle Prorating: Monthly charges are not prorated. You pay the full monthly rate for your current feature set regardless of when changes are made;
4. Lock Expiration: When your price lock period expires, your plan price adjusts to the then-current rates at your next billing cycle. You will receive at least 30 days’ notice before your lock expires;
5. Included Benefits: All custom plan subscribers receive elevated rate limits on basic platform features (equivalent to the Pro tier) regardless of which specific premium features they select;
6. One Plan at a Time: You may have either a fixed tier membership or a custom plan, not both simultaneously. Subscribing to one cancels the other.

14.1 Our Content

The Site and its original content (excluding User Content), features, functionality, design, logos, trademarks, and service marks are and shall remain the exclusive property of UrbanThrifter and its licensors. The Site is protected by copyright, trademark, and other intellectual property laws of the United States and international treaties.

14.2 Limited License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial purposes, subject to these Terms. This license does not include:

• Any resale or commercial use of the Site or its contents;
• Any systematic collection or extraction of data or content from the Site (scraping, data mining, or similar methods);
• Any derivative use of the Site or its contents;
• Any use of the Site or its contents for the purpose of building a competing product or service;
• Downloading, copying, or reproducing Store Listing data for use outside the Site.

14.3 Trademarks

“UrbanThrifter,” the UrbanThrifter logo, and any other product or service names, slogans, or logos displayed on the Site are trademarks of UrbanThrifter and may not be used without our prior written permission. All other trademarks displayed on the Site are the property of their respective owners.

You agree not to engage in any of the following prohibited activities:

1. Unauthorized Access: Attempting to access any portion of the Site, servers, or databases that you are not authorized to access;
2. Scraping & Data Mining: Using automated tools, bots, spiders, scrapers, or similar technology to collect, extract, or index content from the Site without our written permission;
3. Interference: Interfering with or disrupting the Site’s infrastructure, servers, or networks, including transmitting malware, viruses, or denial-of-service attacks;
4. Impersonation: Impersonating any person or entity, or falsely claiming an affiliation with any person or entity;
5. Fake Check-ins: Submitting fraudulent check-ins at stores you have not physically visited, or using automated methods to generate check-ins;
6. Spam & Manipulation: Posting unsolicited promotional content, manipulating search rankings, or artificially inflating engagement metrics;
7. Harassment: Harassing, threatening, intimidating, or bullying other users;
8. Illegal Activity: Using the Site for any purpose that is unlawful or prohibited by these Terms, or in any way that could damage, disable, or impair the Site;
9. Reverse Engineering: Attempting to reverse engineer, decompile, or disassemble any software or technology used in connection with the Site;
10. False Listings: Creating or editing Store Listings with intentionally false or misleading information;
11. Commercial Solicitation: Using the Site to send unsolicited commercial messages to store owners or other users without their consent.

Violation of these prohibitions may result in immediate account termination, removal of User Content, and, where applicable, legal action.

The Site integrates with and transmits data to the following third-party services. By using these features, you acknowledge and consent to the applicable data sharing:

16.1 Mapping & Location Services

• Google Maps & Google Directions API — for map rendering, geocoding, route optimization, and driving direction calculations. Your location data may be transmitted to Google. Your use of Google Maps is subject to Google’s Terms of Service and Google’s Privacy Policy.

16.2 Selling Platform Integrations (eBay & Etsy)

• eBay (authorized partner) — When you connect your eBay account via OAuth, UrbanThrifter accesses your active listings, completed sales, and seller fees through eBay’s API. This data is stored on our servers to power the inventory, sales tracking, and analytics features. You may disconnect your eBay account at any time from your dashboard, which revokes API access. Previously synced data remains in your account until you delete it or delete your account. Subject to eBay’s User Agreement;
• Etsy — When you connect your Etsy shop via OAuth, UrbanThrifter accesses your listings and shop receipts through Etsy’s API. The same data storage, disconnection, and deletion policies apply as with eBay. Subject to Etsy’s Terms of Use.

16.3 Merchandise Fulfillment

• Printify (authorized partner) — When you redeem points for branded merchandise, the following personal data is transmitted to Printify for order fulfillment: your name, email address, phone number (if provided), and full shipping address. Printify handles production, shipping, and delivery. Printify also sends order status updates (tracking numbers, delivery confirmation) back to UrbanThrifter via webhooks. UrbanThrifter does not store your payment card information. Subject to Printify’s Terms of Service.

16.4 AI Services

• OpenAI — The AI-powered store description writer sends store information (name, category, location, user-provided prompts) to OpenAI’s API for text generation. No personal user data beyond store details is transmitted. Generated content is returned to UrbanThrifter and is not retained by OpenAI beyond the API request. Subject to OpenAI’s Terms of Use.

16.5 Payment Processing

• Stripe — Membership subscription payments are processed through Stripe. Your payment card information is collected and processed directly by Stripe — UrbanThrifter does not store your full card number. Subject to Stripe’s Services Agreement.

16.6 Email Services

• Email Delivery Service — Newsletter delivery and subscriber management is handled through a third-party email service provider. Your email address and subscription preferences are processed by this service solely for the purpose of delivering communications on our behalf.

16.7 CSV & Data Imports

When you import data via CSV files from third-party platforms (Poshmark, Mercari, Depop, Whatnot, and others):

1. You are solely responsible for ensuring you have the right to export and use data from those platforms;
2. UrbanThrifter is not responsible for the accuracy, completeness, or legality of imported data;
3. Imported data is stored in your account and is subject to the same retention and deletion policies as other user data;
4. UrbanThrifter does not share imported data with the originating platform or any third party.

16.8 Affiliate Relationships & Commission Disclosure

UrbanThrifter participates in affiliate and partner programs with certain third-party platforms. This means we may earn a commission when you interact with content on our Site that links to these platforms. Specifically:

1. eBay Partner Network: UrbanThrifter is a member of the eBay Partner Network affiliate program. When you click on eBay listings displayed through our platform — including Trend Tools, store listings, search results, and product recommendations — you may be redirected to eBay through an affiliate link. UrbanThrifter may earn a commission if you make a purchase or take a qualifying action on eBay after clicking through. This does not affect the price you pay.
2. Printify Partner Program: UrbanThrifter participates in the Printify affiliate program. When you interact with Printify-powered merchandise on our platform or follow links to Printify, we may earn a referral commission. Printify uses a 90-day tracking cookie. This does not affect the price you pay.
3. Etsy Affiliate Program: UrbanThrifter may participate in the Etsy affiliate program. When you click on Etsy listings displayed through our platform, you may be redirected to Etsy through an affiliate link. UrbanThrifter may earn a commission on qualifying purchases. This does not affect the price you pay.

In compliance with the U.S. Federal Trade Commission (FTC) guidelines, EU consumer protection regulations, and applicable laws in all jurisdictions where we operate, we disclose these material relationships. Affiliate commissions help support the free features of the platform.

Where affiliate links appear on the Site, a disclosure notice may be displayed near the linked content to ensure transparency.

16.9 General

These third-party services have their own terms and privacy policies. UrbanThrifter is not responsible for the content, practices, or policies of third-party services. Your interactions with third-party services are solely between you and the third party.

The Site may contain links to external websites. We do not control and are not responsible for the content, privacy practices, or availability of external sites. Linking does not imply endorsement.

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

We comply with applicable data protection laws in the jurisdictions where we operate, including:

• GDPR (EU) and UK GDPR — for users in the European Economic Area and United Kingdom;
• CCPA/CPRA — for California residents;
• PIPEDA and Quebec Law 25 — for Canadian users;
• Australian Privacy Act 1988 — for Australian users;
• APPI — for users in Japan;
• LGPD (Lei Geral de Proteção de Dados) — for users in Brazil;
• POPIA (Protection of Personal Information Act) — for users in South Africa;
• US state privacy laws — including Virginia, Colorado, Connecticut, and others as applicable.

You have certain rights under these laws regarding your Personal Data, including the right to access, correct, delete, and port your data. To exercise your rights, contact us at support@urbanthrifter.com.

By providing your email address — whether during account registration, through a store notification signup form, or any other feature on the Site — you consent to receive electronic communications from UrbanThrifter.

18.1 Types of Communications

We may send you the following types of emails:

1. Transactional emails: Account confirmations, password resets, membership receipts, and changes to these Terms or our policies;
2. Notification emails: Alerts when new thrift stores are added near your selected area of interest, based on the city and region you provide;
3. Newsletters and updates: Site news, feature announcements, thrift crawl highlights, community updates, and curated content;
4. Promotional emails: Occasional offers, partnerships, or event announcements relevant to the thrifting community.

18.2 Consent

By submitting your email address through any form on the Site (including notification signup forms), you affirmatively consent to receive the communications described above. For users in the European Union and United Kingdom, this constitutes your explicit opt-in consent as required by the GDPR and the ePrivacy Directive. You may withdraw your consent at any time (see Unsubscribe below).

For users in Canada, your consent is governed by Canada’s Anti-Spam Legislation (CASL). Express consent obtained through our forms does not expire; however, implied consent (where applicable) is valid for two years from your last interaction with the Site.

18.3 Data Collected

When you sign up for notifications or newsletters, we collect:

• Your email address;
• Your area of interest (city, region, and country) for location-based notifications;
• Your IP address (for anti-abuse and rate-limiting purposes only);
• Your account user ID (if you are logged in at the time of signup).

This data is processed in accordance with our Privacy Policy.

18.4 Frequency

There is no guaranteed schedule for notification or newsletter emails. Notification emails are sent as new stores are added to your selected area. Newsletters and updates are sent periodically at our discretion. We will not send an excessive number of communications.

18.5 Unsubscribe

You may opt out of non-transactional emails at any time by:

1. Clicking the unsubscribe link included in every marketing and notification email;
2. Contacting us at support@urbanthrifter.com to request removal.

Opt-out requests will be honored within 10 business days. Please note that you cannot opt out of transactional emails (such as account-related notices and changes to our Terms) while maintaining an active account.

18.6 CAN-SPAM Compliance

In compliance with the U.S. CAN-SPAM Act, all commercial emails from UrbanThrifter will:

• Include our physical mailing address;
• Contain a clear and conspicuous unsubscribe mechanism;
• Use accurate sender information and subject lines;
• Honor opt-out requests within 10 business days.

We will never sell, rent, or share your email address with third parties for their marketing purposes.

2. Your User Content;

23.1 Informal Resolution

Before initiating any formal dispute proceedings, you agree to first contact us at support@urbanthrifter.com to attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days of receiving your notice.

23.2 Binding Arbitration

If the dispute is not resolved informally, you and UrbanThrifter agree that any dispute, controversy, or claim arising out of or relating to these Terms or the Site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, rather than in court.

The arbitration shall be conducted in California, United States, unless both parties agree to an alternative location or virtual proceedings. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

If you are a consumer in the European Union or United Kingdom, this arbitration provision does not affect your right to bring a claim before your local courts or to use the European Commission’s Online Dispute Resolution (ODR) platform. Mandatory consumer protection laws of your country of residence shall apply.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

If you are a consumer in the European Union, United Kingdom, Australia, Canada, Japan, Brazil, or South Africa, nothing in these Terms deprives you of the protection afforded by the mandatory consumer protection laws of your country of residence. In the event of a conflict between these Terms and the mandatory laws of your jurisdiction, the mandatory laws shall prevail.

UrbanThrifter is operated from the United States. If you access the Site from outside the United States, you do so at your own initiative and are responsible for compliance with local laws.

We make no representations that the Site or its content are appropriate or available for use in all locations. Store Listings are available for locations in multiple countries, but the availability and accuracy of listings varies by region.

Data Transfers: If you are located outside the United States, please be aware that information you provide to us may be transferred to and processed in the United States. By using the Site, you consent to such transfer. For users in the EEA and UK, we ensure appropriate safeguards are in place for international data transfers as described in our Privacy Policy.

26.1 By You

You may stop using the Site at any time. You may delete your account directly from your account settings page — no email or request needed. Deletion is self-service and takes effect immediately. All personal data associated with your account will be automatically purged from our systems upon deletion.

26.2 By Us

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including but not limited to:

1. Breach of these Terms;
2. Fraudulent, abusive, or illegal activity;
3. Requests by law enforcement or government agencies;

UrbanThrifter shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemic, war, terrorism, labor disputes, government actions, power failures, internet disturbances, or acts of third parties.

28.6 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights except as expressly stated herein.
